Acceptable Use Policy — CronusAI
1. Acceptable Use
This Acceptable Use Policy ("Policy") establishes the rules for use of the CronusAI platform, operated by SOFTBLITZ PESQUISA DESENVOLVIMENTO E CONSULTORIA DE SOFTWARE DO BRASIL LTDA - ME ("SoftBlitz," "we," "us"), in compliance with applicable U.S. federal and state laws.
Acceptable use of the platform includes: (a) management of employees and employment relationships; (b) time and attendance recording and approval cycles; (c) creation, execution, and management of employment contracts; (d) payroll processing and payments; (e) document and KYC management; (f) productivity analysis and reporting, within the bounds of law and organization policies; and (g) account and configuration administration by designated roles. Use must be in good faith, with respect for third-party rights, and in compliance with the Terms of Service, Privacy Policy, and applicable law.
2. Prohibited Conduct
The following conduct is expressly prohibited:
- Unauthorized access: Accessing or attempting to access systems, accounts, or data without explicit authorization, in violation of the Computer Fraud and Abuse Act (18 U.S.C. § 1030) ("CFAA").
- Automated extraction (scraping): Using automated tools to extract data at scale without prior authorization, in violation of the Terms of Service and applicable law.
- False identity: Creating accounts or providing information under a false or third-party identity.
- Credential sharing: Sharing username, password, or access tokens with third parties, except when expressly permitted by platform procedures (e.g., official delegation).
- Harassment and illegal content: Using the platform to harass, defame, or disseminate illegal content.
- Illegal content: Storing, transmitting, or disseminating content that violates criminal or civil law, including child sexual abuse material, incitement to crime, hate speech, or material that infringes third-party rights.
The CFAA (18 U.S.C. § 1030) criminalizes unauthorized access to protected computers and damage from such access. The FTC Act (15 U.S.C. § 45) Section 5 prohibits unfair or deceptive acts or practices. CAN-SPAM (15 U.S.C. § 7704) regulates commercial email. The Digital Millennium Copyright Act (DMCA) (17 U.S.C. § 512) provides safe harbor and notice procedures for copyright. Violation of this Policy may result in civil and criminal liability.
3. Security Violations
Security violations include, among others:
- Attempts to exploit vulnerabilities, brute-force attacks, or code injection.
- Unauthorized interception, modification, or blockage of communications or data.
- Use of malware, ransomware, or any malicious software.
- Bypassing authentication, authorization, or access control mechanisms.
- Unauthorized access to data of other organizations or users within the multi-tenant environment.
SoftBlitz reserves the right to cooperate with law enforcement in the investigation and prosecution of cybercrime and to comply with court orders and legal process.
4. Fraud
Use of the platform for fraudulent purposes is prohibited, including: falsification of time records; manipulation of payroll or salary data; signing documents on behalf of third parties without authorization; use of third-party payment or identity data; and any conduct constituting wire fraud (18 U.S.C. § 1343), identity theft (18 U.S.C. § 1028), or similar offenses.
5. Platform Abuse
The following are prohibited: overloading infrastructure with excessive or unauthorized automated requests; reverse engineering, decompilation, or disassembly of the software without authorization; circumventing technical limitations or use restrictions; and using the platform in a manner that impairs availability, integrity, or security of the service for other users.
6. Misuse of Employee Data
The following are strictly prohibited:
- Sale or commercialization: Selling, renting, or otherwise commercializing employee data obtained through the platform.
- Unauthorized sharing: Sharing employee data with third parties outside circumstances permitted by law or the Terms of Service (e.g., authorized processors, government agencies).
- Discrimination: Using employee data for discriminatory purposes based on race, color, sex, sexual orientation, religion, political opinion, national origin, age, disability, or any other characteristic protected by federal law (Title VII, ADA, ADEA) or state law.
The CCPA, state privacy laws, and federal employment discrimination laws impose obligations of protection and confidentiality with respect to worker data. Violation may result in regulatory sanctions, civil liability, and employment-law consequences.
7. Account Security
Users are responsible for: (a) maintaining the confidentiality of their credentials; (b) using strong passwords and, when available, multi-factor authentication; (c) notifying SoftBlitz immediately of any unauthorized use or suspected account compromise; and (d) ensuring that only authorized persons have access to administrative credentials. SoftBlitz is not liable for losses arising from user failure to safeguard credentials.
8. Enforcement and Consequences
SoftBlitz monitors platform use to ensure compliance with this Policy and the Terms of Service. In the event of a violation:
- Warning: For minor or isolated infractions, a warning may be sent to the user or organization.
- Suspension: Access may be temporarily suspended for investigation or until remediation.
- Termination: Contract termination and account closure for serious or repeated violations.
- Law enforcement: Where appropriate, SoftBlitz may report to law enforcement or regulatory authorities for investigation and prosecution.
Enforcement of this Policy does not relieve the user of civil or criminal liability. Due process and defense rights are preserved in internal procedures and before the courts.
